This Policy is framed in compliance with:
The Digital Personal Data Protection Act, 2023 (DPDP Act)
The Information Technology Act, 2000
The SPDI Rules, 2011
The Consumer Protection Act, 2019
In case of any conflict between this Policy and any other Company policy, statutory consumer and data protection rights shall always prevail.
1. Core Privacy Assurance
RestoreX360 is developed with a privacy-by-design architecture. The Company provides the following strong and binding commitments:
✅ We do NOT collect personal data except to the limited extent strictly required for lawful purposes such as license activation, billing, taxation, warranty, refunds, and technical support.
✅ We do NOT sell user data
✅ We do NOT rent user data
✅ We do NOT trade user data
✅ We do NOT use user data for advertising or profiling
2. No Access to User System Data (Product-Level Privacy)
RestoreX360 does NOT access, scan, collect, transmit, monitor, store, or analyze:
Personal files, folders, or documents
Snapshots, restore points, images, videos, or private storage
Browsing history or application usage
Passwords or credentials
Private system logs or activities
All restore, rollback, and recovery operations are processed locally on the user’s device only, unless a user explicitly enables any optional cloud-based feature in the future with free, specific, informed, and unambiguous user consent and separate product disclosure, as required under the DPDP Act, 2023.
3. Limited Lawful Data Processing & Purpose Limitation
Minimal personal data may be processed only where strictly required for lawful business purposes, including:
License activation & validation
Billing, taxation & GST compliance
Refund, replacement & warranty verification
Technical support communication
Legal and regulatory requirements
Such limited data is processed strictly in accordance with Indian law and in accordance with the principles of consent, necessity, proportionality, and purpose limitation under the Digital Personal Data Protection Act, 2023. Such data is never sold, never shared for marketing, and never used for advertising.
This aligns directly with the Company’s Refund Policy, Warranty Policy & Support Policy.
Data Minimization & Purpose Limitation:
The Company collects and processes only such limited personal data as is strictly necessary for clearly defined lawful purposes and does not retain data beyond the duration required for such purposes, unless legally mandated.
4. No Selling, Sharing, or Commercial Exploitation of Data
The Company strictly prohibits:

❌ Sharing user data with advertisers
❌ Providing data to marketing agencies
❌ Behavioral profiling
❌ Data monetization or brokerage
❌ Automated decision-making or algorithmic profiling of users
RestoreX360 operates as a non-tracking, non-advertising, privacy-preserving software.
5. Data Security & Legal Safeguards
Where limited data is lawfully processed, the Company applies:
Restricted access control
Secure storage practices
Industry-standard security frameworks
Internal confidentiality obligations
All data is protected against:
Unauthorized access
Leakage
Breach
Misuse
Cyber exploitation
In the unlikely event of a personal data breach involving limited lawfully processed data, the Company shall notify affected users and the appropriate authority as required under applicable Indian law.
6. Force Majeure Cyber Events
The Company shall not be held liable for data compromise arising solely due to nation-state cyber warfare, acts of terrorism, or government-mandated network shutdowns, unless such compromise is directly attributable to the Company’s proven negligence or willful misconduct.
7. Cross-Border Transfer
The Company does not transfer any personal data outside India unless expressly required for lawful business operations and strictly in accordance with the Digital Personal Data Protection Act, 2023 and applicable Government notifications.
8. Data Retention
Any limited personal data collected for lawful purposes shall be retained only for the duration required for legal, regulatory, taxation, warranty, and dispute resolution purposes, after which such data shall be permanently deleted using secure deletion standards or irreversibly anonymized.
9. User Rights Under Indian Law
In alignment with the DPDP Act, 2023, users retain the right to:
✅ Access their personal data
✅ Request correction or updating
✅ Request erasure (where legally permissible)
✅ Withdraw consent (where applicable)
✅ Lodge privacy-related complaints
✅ Right to nominate another individual to exercise data rights in the event of death or incapacity, as permitted under the DPDP Act, 2023.

10. Data Principal
For the purposes of the DPDP Act, 2023, the user shall be considered the ‘Data Principal’ and the Company shall be the ‘Data Fiduciary’.
11. No Third-Party Tracking Tools
RestoreX360 does NOT embed:
Spyware
Ad trackers
Third-party behavioral analytics
Hidden monitoring tools
If optional diagnostic logs are used for technical support, they are:
Activated only with consent
Used strictly for troubleshooting
Never resold or marketed
Deleted after resolution
This is fully aligned with the Technical Support Policy.
12. Grievance Redressal Mechanism

All grievances shall be resolved as per statutory timelines.
If the user is not satisfied with the resolution provided by the Company, they may escalate the grievance to the Data Protection Board of India as provided under the Digital Personal Data Protection Act, 2023.

Product architecture updates
All updates shall apply prospectively only and will be published on the official website.
Governing Law & Jurisdiction
This Policy shall be governed by the laws of India.
Subject to the Consumer Protection Act, 2019 and the Digital Personal Data Protection Act, 2023, courts at Rajkot, Gujarat, India shall have jurisdiction.
Nothing herein restricts the statutory right of the consumer to approach the appropriate Consumer Dispute Redressal Commission.
